Terms of Service

Last updated: 29 June 2026. Please read these Terms of Service ("Terms") carefully before using EspoVersus. By creating an account, accessing, or using the EspoVersus mobile application or website (together, the "Platform"), you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

In these Terms, unless the context requires otherwise:

  • "EspoVersus", "we", "us", "our" means the operator of the EspoVersus skill-based competitive eSports tournament Platform.
  • "User", "you", "your" means any person who registers for, accesses, or uses the Platform.
  • "Account" means the unique account you create to access the Platform.
  • "Tournament" means a structured, skill-based competitive event organised on the Platform under predefined rules and a bracket or fixture format.
  • "Match" means an individual game (for example a 1v1, 2v2 or 4v4 contest) played as part of a Tournament.
  • "Entry Fee" means the amount payable to register for and participate in a Tournament or Match, used to cover administrative costs and prize pools.
  • "Wallet" means the in-app account ledger that records your Deposit balance, Winnings balance, and bonus credits.
  • "Deposit" means money you add to your Wallet through an approved payment method.
  • "Withdrawal" means a request to transfer eligible Wallet funds to your verified bank account or UPI.
  • "Winnings" means performance-based rewards credited to your Wallet for your results in a Tournament or Match.
  • "KYC" means the "Know Your Customer" identity-verification process required before certain Wallet and Withdrawal activities.
  • "Content" means all text, graphics, logos, software, and other material made available on the Platform.

2. Eligibility

The Platform is intended strictly for adults. You confirm and agree that:

  • You are at least 18 years of age and competent to enter into a legally binding contract under applicable Indian law.
  • You are accessing the Platform from a location in India where participation in skill-based competitive gaming for an Entry Fee is permitted by applicable law.
  • You will not access paid Tournaments from any state, territory, or jurisdiction where participation is restricted or prohibited. Where Entry-Fee participation is restricted in your location, you may use only the free features of the Platform, if any.
  • You are not barred or suspended from the Platform under these Terms.
  • You are participating in your personal capacity and not on behalf of any other person, and you are not impersonating anyone.

We use age-gating and KYC verification to help prevent minors from accessing paid features. We may decline, restrict, or close access where eligibility cannot be reasonably established. It is your responsibility to be aware of, and to comply with, the laws that apply to you in your state or territory before participating in any paid Tournament. If you are unsure whether participation is permitted in your location, you should not join paid Tournaments until you have confirmed your eligibility. We do not provide legal advice, and these Terms are not a representation that participation is lawful in any particular location.

3. Account & Registration

To use the paid features of the Platform, you must register and create an Account. The following terms apply to your Account:

  • One account per person. Each User may hold and operate only one Account. Creating or operating multiple Accounts ("multi-accounting"), or playing through another person's Account, is prohibited and may result in suspension and forfeiture of balances.
  • Accurate information. You must provide true, current, and complete information during registration and keep it updated. Providing false, misleading, or third-party information is a breach of these Terms and may lead to suspension or termination.
  • Unique username. You choose a unique username at registration. For integrity and anti-impersonation reasons, your username is permanent once chosen, and your registered mobile number or email may be locked while your Account is active. Changes to locked details are permitted only through verified support channels and after appropriate verification.
  • Credential security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. Do not share your password or one-time passwords with anyone. Notify us immediately at support@espoversus.com of any unauthorised use or suspected compromise of your Account.
  • Communications. By registering, you agree to receive service-related communications (such as transaction, security, and grievance updates) through the Platform, email, or your registered number. These are essential to the service and are separate from optional marketing messages, which you may opt out of.

4. Wallet — Deposits, Withdrawals & Fees

4.1 Wallet

Your Wallet is an in-app ledger and is not a bank account, e-money instrument, or deposit-taking facility. Funds in your Wallet do not earn interest. Wallet balances are recorded as a Deposit balance, a Winnings balance, and any bonus credits, each of which may be subject to different usage and Withdrawal rules.

4.2 Deposits

You may add funds to your Wallet using approved payment methods. Deposits are processed through third-party payment service providers; we do not store complete card or bank credentials. Deposit funds may be used to pay Entry Fees and are subject to the Refund & Cancellation Policy.

4.3 Withdrawals

You may request a Withdrawal of eligible Winnings to your verified bank account or UPI after completing KYC. A minimum Withdrawal amount and reasonable processing checks may apply. Withdrawals are typically processed within 24 to 72 hours after successful KYC and verification. The bank account or UPI used for Withdrawal must belong to you and match your verified KYC identity. We may delay or decline a Withdrawal where we reasonably suspect fraud, multi-accounting, money laundering, a mismatch in beneficiary details, or a breach of these Terms or the Fair Play Policy, and we may request additional verification before releasing funds.

4.4 Fees

EspoVersus charges a transparent platform service fee (commission) on Tournaments, which is disclosed before you join. Payment gateways or banks may levy their own charges, which are not controlled by us. We do not charge gambling-style hidden fees. Applicable taxes, if any, will be handled in accordance with the law in force at the relevant time.

4.5 Financial Risk

Participation in paid Tournaments involves financial risk. You may lose the Entry Fees you pay. Only participate with amounts you can comfortably afford to lose, and use the responsible-gaming tools described in our Responsible Gaming policy to set deposit and time limits.

5. KYC & Verification

To comply with applicable law and to protect Users, we require identity verification (KYC) before enabling Withdrawals and certain Wallet activities. You agree to provide valid government-issued identity details (for example PAN, e.g. ABCDE1234F) and any additional documents we reasonably request. We use KYC to confirm that you are 18 or older, to verify your identity, to enable secure payouts, and to prevent fraud, money laundering, and underage access.

You confirm that all KYC information you provide is true and relates to you. Submitting forged, altered, or third-party documents is strictly prohibited and may lead to permanent suspension and forfeiture of balances, in addition to any legal consequences. We may periodically re-verify your details, and we may restrict Wallet activity until verification is complete. KYC data is handled in accordance with our Privacy Policy.

6. Tournaments, Matches & Winnings

  • Tournaments and Matches are skill-based competitive contests played under predefined rules and bracket or fixture formats. Outcomes depend on player skill, strategy, and performance.
  • The specific rules, format, Entry Fee, prize structure, and schedule of each Tournament are shown before you join. By joining, you accept those rules.
  • Winnings are performance-based and are credited to your Wallet according to the published prize structure once results are confirmed.
  • We may verify results, request evidence (such as in-game screenshots), and hold prize settlement pending review of fair-play and anti-cheat checks.
  • Where a Match cannot be completed for technical reasons attributable to the Platform, we may cancel and refund the Entry Fee as set out in the Refund & Cancellation Policy. If you disconnect or leave a Match, the last recorded result generally governs.

7. Fair Play

You agree to compete honestly and to comply with our Fair Play & Anti-Cheat Policy, which forms part of these Terms. Use of cheats, hacks, bots, mods, unauthorised software, collusion, match-fixing, multi-accounting, or any manipulation of results is strictly prohibited. We deploy detection and monitoring tools, including device-integrity and anti-cheat checks, to protect competitive integrity.

8. Prohibited Conduct

When using the Platform, you must not:

  • Create multiple Accounts, share Accounts, or sell, buy, or transfer Accounts.
  • Use cheats, hacks, bots, emulators where prohibited, automation, or any tool that confers an unfair advantage.
  • Collude, fix Matches, or engage in any arrangement to manipulate outcomes.
  • Provide false identity or KYC information, or impersonate any person.
  • Use the Platform for money laundering, fraud, or any unlawful purpose.
  • Attempt to access, probe, or disrupt our systems, or reverse-engineer the Platform.
  • Harass, abuse, threaten, or post unlawful, obscene, or infringing content.
  • Use the Platform if you are under 18 or from a restricted location.

9. Suspension & Termination

We may suspend or terminate your Account, withhold Withdrawals, and forfeit ineligible balances or Winnings where we reasonably determine that you have breached these Terms, the Fair Play Policy, or applicable law, or where required by a competent authority. We will, where practicable, give notice and an opportunity to respond, except where immediate action is necessary to protect Users, the Platform, or to comply with law. You may close your Account at any time as described in our Privacy Policy and Refund & Cancellation Policy; certain records may be retained as required by law.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that third-party games, networks, or devices used to play Matches will perform without fault. EspoVersus does not claim to be government approved, OGAI certified, or registered, and nothing on the Platform should be read as such a claim. Participation for an Entry Fee involves financial risk; you may lose the amounts you stake.

11. Limitation of Liability

To the maximum extent permitted by applicable law, EspoVersus and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or Winnings, arising out of or in connection with your use of the Platform. To the extent liability cannot be excluded, our aggregate liability to you for any claim is limited to the total Entry Fees you paid for the specific Tournament or Match giving rise to the claim, or the eligible Wallet balance affected, whichever is lower.

12. Intellectual Property

All Content on the Platform, including the EspoVersus name, logo, software, design, and graphics, is owned by us or our licensors and is protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial participation in Tournaments. Third-party game titles, trademarks, and content remain the property of their respective owners; EspoVersus is an independent tournament platform and is not endorsed by or affiliated with those owners unless expressly stated.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to the Dispute Resolution and Grievance Redressal sections below, the courts of competent jurisdiction in India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Platform.

14. Dispute Resolution

If a dispute arises, you agree to first contact our support and grievance channels so we can attempt a good-faith resolution. In-Tournament disputes (for example, contested results) are reviewed internally against published rules and fair-play checks. If a dispute cannot be resolved through these channels, it shall be subject to the Governing Law & Jurisdiction section above. Nothing in these Terms limits any statutory rights or remedies available to you under applicable law.

15. Grievance Redressal

In line with applicable Indian law, we operate a clear grievance-redressal mechanism. You can raise a grievance through the in-app support section or by writing to the Grievance Officer, EspoVersus at grievance@espoversus.com.

  • We will acknowledge your grievance within 24 hours of receipt.
  • We will endeavour to resolve your grievance within 15 days of receipt.
  • If you are not satisfied with the resolution, you may escalate the matter to the relevant Authority within the timelines provided under the applicable online-gaming and data-protection laws (generally within 30 days of our response).

Data-protection grievances are handled in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023.

16. User Content & Licence

You may submit content such as a username, avatar, messages, dispute evidence (for example screenshots), and support tickets ("User Content"). You retain ownership of your User Content, but you grant EspoVersus a non-exclusive, royalty-free licence to host, store, display, and process it as needed to operate the Platform, resolve disputes, and comply with law. You are responsible for your User Content and must ensure it is lawful, accurate, and does not infringe the rights of others. We may remove User Content that violates these Terms or applicable law.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless EspoVersus and its officers, employees, and partners from and against any claims, damages, losses, liabilities, and reasonable expenses arising out of your breach of these Terms, your violation of any law or third-party right, or your misuse of the Platform.

18. Third-Party Games & Services

Matches are played on third-party game titles and over third-party networks and devices that are outside our control. We are not responsible for the availability, performance, rules, updates, or bans imposed by those third-party games or services. Your use of any third-party game is also subject to that game's own terms.

19. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including network or power outages, third-party platform failures, natural events, or actions of authorities. In such cases, affected Tournaments may be rescheduled, cancelled, or refunded as appropriate under the Refund & Cancellation Policy.

20. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of that right. You may not assign or transfer your rights under these Terms; we may assign our rights to a successor in connection with a reorganisation or transfer of the business. These Terms, together with the policies referenced in them, constitute the entire agreement between you and EspoVersus regarding the Platform.

21. Changes to Terms

We may update these Terms from time to time to reflect changes in law, technology, or our services. We will post the updated Terms on the Platform and update the "Last updated" date. Material changes will be notified through the Platform where reasonably possible. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
